Argyll FM Limited is a not-for-profit private company limited by guarantee (SC160070) that is also a charity registered in Scotland (SC052427) and has its principal office at 27-29 Longrow, Campbeltown, Argyll, UK, PA28 6ER.
On paying a subscription to become a Supporter or Partner of Argyll FM or applying to become a Member of the Company of Argyll FM Limited, you are automatically agreeing to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with data protection laws and our data protection policies. References herein to “Argyll FM”, “the Company”, “we” or “us” are references to Argyll FM Limited.
The commencement of your subscription will bring into force a legally binding contract between us and these terms and conditions will form the basis of that contract through which Argyll FM will deliver a service to you as a Supporter, Partner or Company Member.
As a subscribed Supporter or Partner, the benefits you are entitled to receive are limited to those described by these terms & conditions, and being a subscribed Supporter or Partner does not mean that you are a Member of the Company of Argyll FM Limited, or that you hold any of the rights described in the Company’s Articles of Association, including the right to attend and vote at the Company’s Annual General Meeting. Membership of the Company is completely separate from and unrelated to the Supporter and Partner subscriptions described by these terms & conditions.
If you are, however, making an application for Membership of the Company and paying the subscription for this, your Membership (including the application for your Membership) is subject to both the relevant sections of these terms and conditions and the relevant sections of the Articles of Association of Argyll FM Limited relating to Membership of the Company (which take precedence over these terms and conditions in any area where they are found to overlap).
1.1 If you subscribe as a Supporter you will have a range of benefits available to you. The maximum package will normally include:

If you subscribe and successfully apply to be a Company Member you will have a range of benefits and also some responsibilities, in summary:
1.2 We reserve the right to change or withhold the benefits that apply to your subscription at any time and without prior notice. Where possible, changes to benefits will be published on the Argyll FM website.
1.3 We may maintain, cancel or introduce different subscription types from time to time. It is your responsibility to ensure that you have the most appropriate type of subscription to suit your personal circumstances at any time. Argyll FM is not responsible in the event that a more appropriate category of subscription may have been available at any time.
2.1 Supporters and Company Members should be prepared to show their digital membership card as a form of proof of subscription when they visit our premises for any pre-arranged visit or for any special event. We may not allow entry to our properties or events without sight of your digital membership card.
Partners or anyone representing a Partner organisation should be prepared to show their partnership certificate as a form of proof of subscription when they visit our premises for any pre-arranged visit or for any special event. We may not allow entry to our properties or events without sight of a valid partnership certificate. Where someone is representing a Partner organisation, proof of their affiliation to that organisation will also be required.
2.2 No subscription may be transferred to another person or organisation and subscribers are not permitted to allow another person to use their digital membership card or partnership certificate (as applicable) or to share their login credentials for the Argyll FM website. Partner organisations are additionally not permitted to allow a person unaffiliated with their organisation to use their partnership certificate.
2.3 The Supporter and Company Member subscriptions allow only the named subscription holder to access subscription benefits.
The Partner subscription allows only the named subscription holding individual or any verified representative of the named subscription holding organisation to access subscription benefits.
2.4 All subscriptions are valid from the date of confirmation of subscription by Argyll FM until the date of expiry shown on the account section of the Argyll FM website or the digital membership card or partnership certificate (as applicable), being not less than one year.
2.5 Digital membership cards will generally be available immediately after confirmation of your subscription via the account section of the Argyll FM website.
Partnership certificates will generally be supplied within five days of confirmation of your subscription.
2.6 A subscription does not automatically entitle subscribers to attend events hosted by Argyll FM, including tours or other activities in our properties, which specifically require additional payment.
2.7 Entry to our studio and office premises is by pre-arranged appointment during our opening hours only. Opening hours may vary and will be advertised on the Argyll FM website. Although we will endeavour to adhere to advertised opening hours we reserve the right to change opening hours or close our property at any notice for any reason. Please check our website before visiting. Entry to our properties or events is subject to separate terms and conditions of entry. We reserve the right to restrict entry as we see fit or to demand that any Supporter, Partner or Company Member leave a property or event for reasons of health or safety or if we consider that it is in the best interests of Argyll FM or our staff, volunteers or other visitors.
2.8 Gift subscriptions are not currently available, therefore subscriptions should only be purchased by the intended holder of that subscription.
2.9 Only one subscription may be held at any time, therefore purchasing a subscription while another subscription remains active will result in the older/existing subscription being cancelled without a refund.
2.10 Our subscription fees are inclusive of the fees we pay per transaction to our electronic payment processor, however these fees may be deducted from any refunded amount.
3.1 Argyll FM reserves the right to refuse any application for any subscription type. Argyll FM also reserves the right not to fulfil or to cancel a subscription if a subscriber is found to be in breach of these conditions.
3.2 On receipt of your order we will debit your card or process the Direct Debit payment or other electronic money transfer, or process your cheque for the price (as applicable). However, our acceptance of your offer remains subject to approval of it by us. Once a decision has been reached we will either confirm that your application for subscription has been accepted, at which point a contract will be formed between us, or notify you that we cannot accept your application. If we cannot accept your application for whatever reason we will confirm that your account has been re-credited (if applicable).
3.3 If we are unable to obtain payment authorisation from the issuer of your card or from your bank in the case of Direct Debit or other electronic payments and a subscription has already been issued to you, we will terminate the subscription and you will forfeit any benefits.
4.1 All quoted subscription fees are for a one-year subscription, set to renew automatically on an annual basis indefinitely unless cancelled.
4.2 We reserve the right to increase the price of your subscription on an annual basis if we deem it necessary. You will be informed of any fee increase by email.
5.1 The credit/debit card information you provide us for a subscription transaction is used solely for the purpose of processing that subscription transaction. If we are unable to process payment from the credit/debit card details you have provided we will contact you immediately to verify your card details.
5.2 We strongly advise you against sending us any credit/debit card information via email. It is contrary to the rules of the Payment Card Industry (PCI) for us to accept credit/debit card payments by email and we will decline to accept payment by this means.
5.3 If you are not using your own credit/debit card to pay for the subscription, you must ask permission of the credit/debit card holder before entering payment details. When you apply for a subscription with Argyll FM, you are confirming that you have obtained the express prior permission of the credit/debit card holder.
6.1 If there are any changes to the amount, date or frequency of your Direct Debit, Argyll FM will notify you 10 working days in advance of your account being debited or as otherwise agreed. If we request to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
6.2 If an error has been made in the payment of your Direct Debit by us or your bank/building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. If you receive a refund you are not entitled to, you must pay it back when requested to do so by Argyll FM.
6.3 You can cancel a Direct Debit by contacting your bank or building society. Written confirmation may be required. However, cancellation of your direct debit is not the same as cancellation of your subscription which may require notice to be given to us. Please see Section 7 below. If you cancel or choose not to renew your subscription you must also notify us using the method set out in Section 7.9 below.
7.1 As a consumer, you have a legal right to cancel the contract formed between us (and receive a refund of the fees paid) within 14 days if you change your mind or decide for any other reason that you do not want to continue your subscription.
7.2 Your legal right to cancel the contract starts from the date on which we confirm that your application for subscription has been accepted or from renewal, which is when the contract between us is formed. Your deadline for cancelling the contract is 14 days after the day on which this contract was formed. To cancel a contract in this way, you need to let us know that you have decided to cancel. Please see Section 7.8 below to find out how to notify us.
7.3 If you cancel the contract in accordance with Section 7.2 we will:
7.3.1 refund you the price you paid for the subscription. Please note we are permitted by law to reduce your refund to reflect the period of time (if any) that the subscription was valid up to the date on which we were notified of your decision to cancel the contract; and
7.3.2 make any refunds due to you as soon as possible.
7.4 After 14 days have passed you will not receive any refund if you cancel your subscription. You must give us at least 3 months’ notice ahead of renewal to let us know that you have decided to cancel your subscription for the following year.
7.5 If you cancel the subscription contract in accordance with Section 7.4 your subscription will continue for 3 months during the notice period and we will not take any further payments after the end of the 3 months. However, we will not refund to you any payments already made and you may still have to make payments during the 3 month notice period (if applicable).
7.6 In the event that your subscription is cancelled for any reason you will no longer be entitled to receive any subscription benefits.
7.7 The subscription and any associated benefits shall cease on death but no refund shall be made.
7.8 To let us know that you wish to cancel your subscription or not renew your subscription, you must cancel your subscription via the Argyll FM website or notify us in writing at membership@argyllfm.com.
8.1 Gift Aid is a government scheme that adds 25p to every £1 you give to charity – at no extra cost to you. It is an easy way to ensure that charities, like us, receive more benefit from the money given to them. Subscribers who sign up to Gift Aid will be making a much-valued additional contribution to the charitable work of Argyll FM.
Gift Aid allows us to claim tax back from HMRC on your subscription/donations. It doesn’t cost you a penny and your support will help to fund our important work.
To sign up to Gift Aid, ensure you have consented to do so by agreeing to the Gift Aid declaration, if you are eligible to do so, in the registration form.
9.1 When you apply for a subscription with Argyll FM (and throughout the course of your subscription) it will be necessary for us to obtain certain information from you (such as your name, address and date of birth). We will treat this as personal data for the purposes of data protection law. Argyll FM will collect, hold and process your personal data in accordance with our Privacy Policy.
10.1 Subject to Section 10.3, and to the extent possible by law, Argyll FM excludes all liability to subscription holders or to any other third party for any loss of profit, or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with services, benefits and/or products supplied by Argyll FM or any company associated with Argyll FM.
10.2 Subject to Section 10.3, the liability of Argyll FM to you is limited to the amount of your subscription fee.
10.3 Nothing in these terms and conditions excludes liability for death or personal injury caused by the Company’s negligence or for fraud or fraudulent misrepresentation.
Argyll FM will aim to respond to any query received within seven working days. This may be an acknowledgement of receipt whilst further investigations are carried out. If you have any queries or complaints please contact our team by email at: membership@argyllfm.com.
These terms and conditions are governed by the laws of Scotland.
Anything said by any individual on our behalf should not be understood as a variation of these terms and conditions, nor as a representation about the nature and quality of the services being offered by us.
